Commission Terms of Service

Thank you for your interest in commissioning work from Ferious Development LLC ("Ferious Dev," "we," "us," or "our"). These Terms of Service ("TOS") outline the agreement between you ("Client," "you," or "your") and Ferious Dev for the creation of commissioned digital assets.

By commissioning work from us, you agree to be bound by these TOS. Please read them carefully.

1. Commission Process

• Initial Inquiry: Contact us with your commission request, providing detailed specifications. Be as specific as possible about your needs, including desired features, design elements, and any reference materials.
• Acceptance and Quote: We will review your request and provide a quote and estimated delivery timeframe.
• Work Commencement and Revisions: Upon your acceptance of the quote, we will begin work. We may offer a reasonable number of revisions within the original scope. Significant changes beyond the initial scope may incur additional fees.
• Delivery and Payment: Assets will be delivered electronically. Full payment is due upon completion and delivery of the commissioned work.

2. Grant of License

Ferious Dev grants you a non-exclusive, non-transferable license to use the commissioned digital asset(s) for personal or internal business purposes.

• No Redistribution: You may not redistribute the commissioned digital asset(s).
• No Commercial Gain: You may not resell, lease, or modify the asset(s) for commercial gain.
• No Reverse Engineering: You may not attempt to unlock, "rip," or reverse engineer the commissioned asset(s).

3. Resale and Exclusive Rights

Ferious Dev retains the right to resell commissioned digital assets if another client requests an identical asset.

• Exclusive Rights Option: Clients may purchase exclusive rights for a fixed fee of $35. This ensures Ferious Dev will not resell, reproduce, or distribute the asset(s) in any way.

4. Limitations

We reserve the right to decline requests at our discretion. We currently do not undertake commissions involving:

• Heavy Rescue Vehicles / Ladder Trucks
• CHP or MSP Branded Vehicles
• Projects lacking necessary materials or expertise.

5. Payment and Refunds

• All payments are final and non-refundable.
• Cancellations: If you cancel after work has commenced, we may retain a portion of the payment to cover work completed to that point.
